PopiScan is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind. It is designed to assist event organizers, schools, and photographers with internal consent bookkeeping. It is not legal advice, not a substitute for an Information Officer audit, and provides no statutory warranty or immunity. Facial detection is probabilistic and subject to false negatives. You and your organization are solely responsible for obtaining valid consent and deciding which photos are published.

1. Provision of Software "As Is" & No Warranty

PopiScan (popiscan.co.za) is provided free of charge on an "AS IS" and "AS AVAILABLE" basis. The authors and operators disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, algorithmic accuracy, and uninterrupted operation.

YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THIS SOFTWARE. NO WARRANTY IS MADE THAT SCANNING WILL DETECT EVERY FACE OR MEET REGULATORY REQUIREMENTS.

2. Operational Aid Only — Not Legal Advice

PopiScan is not a law firm or registered regulatory body. Status badges ("Compliant", "Violation", "Review") and generated audit certificates reflect automated heuristics evaluated against local inputs. They do not constitute official statutory certification or legal advice under the Protection of Personal Information Act 4 of 2013 (POPIA).

3. Algorithmic Limitations & Inherent Probabilistic Nature

In-browser face detection (Viola-Jones / Haar cascades) is probabilistic. False negatives (missed faces due to lighting, angles, occlusions, sunglasses, headwear, or crowds) and false positives can occur. Mandatory human visual inspection is required before publishing or distributing any photograph.

4. Sole Responsibility of the User ("Responsible Party")

Under POPIA Section 1, your organization is the legal Responsible Party. You hold sole accountability for verifying parental consent for minors (Section 35), managing consent records, honoring opt-outs, and making publishing decisions.

5. Comprehensive Limitation of Liability

Under no legal theory (contract, delict, negligence, or statute) shall the developers, contributors, or hosts of PopiScan be liable for:

  • Administrative fines or enforcement actions by the Information Regulator of South Africa (including Section 109 fines up to R10,000,000);
  • Civil claims, privacy infringement damages, or lawsuits under Section 99 of POPIA;
  • Legal defense costs, lost profits, business interruption, or emotional distress damages.

6. 100% Client-Side Architecture & Zero Data Retention

All photo processing, face detection, and redaction occur 100% within your web browser's local sandbox memory. No photos, biometric descriptors, or roster records are ever transmitted to or stored on our servers. The site operators never possess your data and are not an "Operator" under POPIA. The complete client-side source code is open for independent security audits on GitHub under GPLv3.
